Overview

Welcome to Moka Memento. These Terms of Service apply when you use our website or purchase from us. By placing an order, you agree to these terms. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Our products

Moka Memento creates personalised moka pots in Melbourne, Australia. Product photographs and digital previews are illustrative. Colours, placement and scale may vary slightly between screens, previews and the finished product.

Personalisation and uploaded content

You are responsible for checking your selected image, artwork, spelling and preview before ordering. You confirm that you own, or have permission to use, all content you upload and that it does not infringe another person’s rights or contain unlawful or offensive material. You give us a limited licence to use the uploaded content only as reasonably necessary to create, administer and deliver your order. We may refuse or cancel an order containing content we reasonably consider unlawful, infringing or unsuitable, in which case we will refund any amount paid for the cancelled item.

Orders, prices and payment

An order is accepted when payment is successfully processed and we confirm the order. Prices, currencies, availability, shipping charges and any taxes collected by us are shown at checkout and may change before an order is placed. We may correct genuine pricing, description or availability errors. If an error affects an order already placed, we will contact you and offer the choice of proceeding on the corrected basis or receiving a refund.

Production and order changes

Each moka pot is personalised to order. Our current production allowance is approximately 2 business days and is included in the delivery estimate shown at checkout. If you need to change or cancel an order, contact us immediately. We cannot guarantee changes or cancellation once production has begun.

Shipping destinations and delivery

We currently ship within Australia and to New Zealand, the United States, Canada and supported European Union destinations. Available destinations, shipping charges and delivery estimates are confirmed using the delivery address entered at checkout. Delivery estimates are not guaranteed and may be affected by carrier, customs, weather, peak-period or destination delays. Risk of loss passes as provided by applicable law and the carrier’s delivery terms.

European Union import VAT, duties and fees

EU orders are shipped on a Delivered At Place (DAP) basis. Prices and shipping charges paid to Moka Memento do not include EU import VAT, customs duties, brokerage, disbursement or other import-related charges. These amounts are not collected by us and are the customer’s responsibility. The carrier or customs authority may require payment before or upon delivery. Refusing to pay import charges may cause delay, return or disposal of the shipment. Any resulting carrier, return or administrative costs may be deducted from a refund where permitted by law.

Customs information

You are responsible for providing a complete and accurate delivery address and any information reasonably required for customs clearance. We will declare the order accurately and will not mark commercial purchases as gifts or understate their value.

Returns, faults and remedies

Because personalised products are made specifically for you, change-of-mind returns are generally not available. This does not affect rights that cannot be excluded. If your order is faulty, damaged, materially different from what was ordered or otherwise fails to meet a consumer guarantee, contact hello@mokamemento.com promptly with your order number and photographs so we can assess an appropriate repair, replacement, refund or other remedy.

Website use and intellectual property

The Moka Memento website, branding, designs, text, photographs and other content are owned by or licensed to us. You may not copy, reproduce, distribute or commercially exploit them without permission, except as allowed by law.

Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from use of the website or a product. Where liability cannot be excluded, it is limited only to the extent permitted by applicable law. Nothing in these terms limits any non-excludable consumer guarantee.

Privacy

Our collection and use of personal information is explained in our Privacy Policy. Shopify and payment, delivery and service providers may process information as required to operate the store, complete payment and fulfil orders.

Changes to these terms

We may update these terms from time to time. The terms published when you place an order apply to that order unless a change is required by law.

Governing law

These terms are governed by the laws of Victoria, Australia, subject to any mandatory consumer protections that apply in your place of residence.

Our products are personalised using the image, logo or artwork you provide. Please make sure you have the right to use the image you upload. You are responsible for checking the preview before placing your order.

Orders and payment

Orders are confirmed once checkout is completed and payment is accepted through Shopify checkout. Prices and availability may change from time to time.

Personalisation and production

Because each custom moka pot is made with your selected image, we prepare the product based on the uploaded file and preview attached to your order. Small differences in colour may occur between screens and printed output.

Shipping

Shipping options, costs and delivery estimates are shown at checkout where available. Delivery timeframes are estimates and may vary because of carrier delays or destination conditions.

Returns

Because personalised products are made specifically for each customer, change-of-mind returns may not be available. If your order arrives damaged or incorrect, please contact us at hello@mokamemento.com so we can review it.
